This paper aims to offer a definition of excessive profit for cases of exploitation. Most of the literature that aims to identify cases of exploitation focus on determining a fixed price, and suggests that profit is excessive when individuals deviate from this price. More recently, Joe Horton has proposed an indifferent benchmark between transacting with a vulnerable party and not transacting with her. After arguing against the existing focus on prices, the paper proposes an alternative approach to exploitation which focuses (...) on the profit made by the purported exploiter party. It suggests that profit is excessive when an agent makes more profit than the profit that a non-vulnerable purported exploiter would have made when transacting with a non-vulnerable second party. The focus on profit leads to the conclusion that different prices may be non-exploitative depending on the situation of the agents involved. (shrink)

In this paper we distinguish, from other sanctions, specific targeted sanctions—namely those imposed on particular individuals and sanctions on goods that facilitate the violation of human rights. We ask if these sanctions satisfy the three of the principles of Just War Theory (JWT): chance of success, proportionality and discrimination. We argue that while there is not enough empirical evidence to make a claim about specific targeted sanctions and chance of success, these sanctions do meet the principles of proportionality and discrimination, (...) which are not met by other sanctions. Our ultimate conclusion is that comprehensive sanctions, and some types of targeted sanctions—e.g., those that target sectors of the economy or dual-goods such as oil—cannot be justified, since there is another type of sanctions, namely specific targeted sanctions, that meet the principles of JWT, and hence, are fairer. Abstract:In this paper I focus on parasitic cases of exploitation in the case of UBI. I start by arguing that existing concepts of parasitic exploitation in the literature are over inclusive, since they label as cases of parasitic exploitation some cases that are not. Then I offer my own narrower framework of parasitic exploitation, which includes three conditions: built-in mechanisms, structural vulnerability and non-proportionality. I suggest that exploitation happens when agents misuse a system to obtain additional profit at the potential (...) expense of the weak party. This profit is additional compared to a counterfactual scenario in which the systemic vulnerability was not present. I argue that while some cases of parasitic exploitation may arise in the case of UBI, these cases are likely to be weak, and hence, absence of regulation of this system can be justified on the grounds that this would prevent stronger types of exploitation and domination.Key words: Universal Basic Income; parasitic exploitation; transactional exploitation; domination; misusing a system; free-rider. Resumen: El estatuto teórico del concepto de la violencia escolar se ha resuelto parcialmente mediante el uso de definiciones. En el caso del campo científico chileno las definiciones de violencia escolar se formulan desde una episteme dualista, que establece la distinción entre lo escolar y lo no escolar, priorizan a un individuo abstracto, donde el espacio prima sobre el tiempo, las relaciones son causales y, en menor medida, de tipo covariación, constructiva de realidades y especular. El componente performativo es doble: (...) i) un modo de codificación y clasificaciones que estabilizan a un objeto que irrumpe en el campo científico y escolar; ii) producen una ausencia y exclusión de las relaciones y categorías posibles. No obstante, se observa que al interior de las propias definiciones se encuentran las semillas para un trabajo de transformación hacia epistemes no dualistas y complejas mediante las dimensiones de producción, reproducción y cruce de las violencias en la institución escolar según un enfoque tríadico. Esta reconstrucción se basa en un corpus de artículos indexados del campo de la educación sobre Chile entre los años 2001 a 2013.: The theoretical statute of the concept of school violence has been partly solved using definitions. In the case of the Chilean scientific field, the definitions of school violence are defined from a dualistic episteme that establishes the distinction between what is part of the school and what is not, that prioritizes an abstract subject, where space is more important than time, the relationships are of causal type and, to a lesser extent, of covariation type, that builds realities and that is speculative. The performative component has two aspects: i) a coding mode and classifications that stabilize an object that disrupts the scientific and school fields, and ii) produce a lack and exclusion of the relationships and potential categories. Nevertheless, it has been observed that there are some elements within the own definitions that could work for the transformation of dualistic and complex epistemes, through a dimension of production, reproduction, and the cross of different types of violence at school, following a triadic approach. En este texto se sostiene la necesidad de subrayar el problema del mal en las reflexiones sobre el castigo jurídico y la justicia penal. Para desarrollar lo anterior, (1) se exploran las razones por las que esta discusión no tiene un lugar preponderante en la iusfilosofía contemporánea, principalmente: (a) la idea de que el mal es una reflexión exclusivamente religiosa o que solo tiene sentido como preocupación teológica, y (b) la idea de que el interés por el mal nos lleva (...) necesariamente a derroteros antiberales. Después, (2) se da cuenta de algunos planteamientos básicos de la reflexión filosófica sobre el mal desarrollada durante el siglo XX, cuando ésta es rehabilitada tras las atrocidades de las grandes guerras. (3) Finalmente, se recupera el potencial de esta literatura en la reflexión sobre el castigo, especialmente en lo que respecta a la toma de consciencia sobre las experiencias del mal de nuestro tiempo, y la necesidad de afrontarlo y dar una respuesta. The main aim of the study is to ascertain contrastively, in English and Spanish, how directive speech acts are represented in film discourse. For the purpose of the investigation, the directive speech acts of 24 films, 12 in English and 12 in Spanish, were extracted and analysed. A classification taxonomy, inspired by previous research, was created in order to categorize the different types of directive speech acts and determine their level of (in)directness. The results show that indirectness is more widely (...) represented in the English than in the Spanish film scripts, thus confirming the assertion that being indirect is a distinctive feature of English native speakers (Grundy, 2008). This research makes a valuable contribution to the exploration of speech acts in filmspeak and informs the existing local grammar descriptions of the linguistic patterns of directive speech acts. The ever‐increasing demand for organs led Spain, France, and other European countries to promote uncontrolled donation after circulatory determination of death (uDCDD). For the same reason, New York City has recently developed its own uDCDD protocol, which differs from European programs in some key ways. The New York protocol incorporates a series of technical and management improvements that address some practical problems identified in response to European uDCDD protocols. However, the more fundamental issue of whether uDCDD donors are dead when (...) organs are procured remains problematic for the New York City protocol and, indeed, for all uDCDD protocols. In the United States, two amendments to the legal criteria of death have been suggested to avoid a formal violation of the dead donor rule in DCDD protocols: first, replacing the requirement “irreversible” with the weaker term “permanent,” and second, using the term “circulatory” instead of “cardiac” to identify the key function that must be lost to declare death. While intended to facilitate controlled DCDD, these modifications create a problem for uDCDD protocols: if extracorporeal membrane oxygenation is introduced to preserve the organs, then circulation is restored after death is declared. In this issue of the Hastings Center Report, Kevin Munjal and colleagues call for a new ethical construct and policy so that uncontrolled and controlled DCDD can coexist. (shrink)

Se presenta un protocolo orientado a interpretar las prácticas científicas desde una perspectiva microscópica. Si bien existe una vasta literatura sobre este enfoque –por ejemplo, el constructivismo científico– aquí se hará hincapié, fundamentalmente, en el entramado psico-técnico que implica la elaboración de los componentes lógicos, teóricos y metodológicos del trabajo investigativo; temática postergada por perspectivas que, como la mencionada, han obnubilado su complejidad y relevancia. A objeto de reestablecer la autonomía del espacio técnico-racional de la labor científica, aquí, bajo la (...) inspiración de Gastón Bachelard, se propone el concepto de fenomenotecnia situada en tanto recurso que puede guiar los análisis sobre la construcción de protocolos teóricoconceptuales en un proceso de investigación. Al contrario de lo que se estila en la mainstream science del campo, la hipótesis apela por la centralidad de la racionalidad científica, en tanto característica irreductible del entramado socio-psico-técnico de las prácticas científicas. One character in Cortázar's novel truly believes in cosmic rhythm. This belief is characteristic of a magical view of the universe central to 1960s counterculture. The other characters in Los Premios, like the implied narrator, reject Persio's essentialism; they dismiss the notion that there is really any rhythm common to art, humanity, and the universe. However, there are key points in the narrative, inspired by falling in love and by works of art, at which their world does appear patterned by (...) just such a rhythm, a ‘swing cósmico’. The novel itself turns out to depend on the intermittent conviction of this rhythm, not objectively embedded in anything, but always seen, living, and dying in time; the price of art is the acceptance of this rhythmed mortality. Duas hipóteses guiaram o desenvolvimento deste trabalho. A primeira afirma o _status_ necessariamente epistêmico e, portanto, não ontológico, do espaço e do tempo na filosofia transcendental. A segunda é a de que o espaço e o tempo como formas _a priori_ da intuição sensível apresentam uma dimensão essencialmente não conceitual da experiência perceptiva. Em vista disso, neste artigo, nossa intenção é trilhar o caminho argumentativo da constituição da idealidade transcendental do espaço e do tempo a fim de compreender esse estatuto (...) epistêmico e não conceitual da intuição. O objetivo é o de analisar as consequências dessas duas hipóteses para a filosofia neo kantiana contemporânea que tenta compatibilizar os argumentos kantianos com os de uma posição não conceitualista. Para tanto, vamos analisar o desenvolvimento das noções de espaço e tempo, no chamado período de transição da filosofia kantiana, da fase pré-crítica à fase crítica, bem como no próprio período crítico, que culmina na doutrina da idealidade transcendental do espaço e do tempo. This paper analyzes the presence of the Fatimid gold coins in al-Andalus and its link with the coinage of the taifa states, through a review of the hoards, from treasures to isolated pieces. This analysis allows to get a full view of the Fatimid gold coinage found in al-Andalus. Also allows to quantify and to establish the extent of the presence of this coinage. The Fatimid gold coinage is frequently treasured next to some taifa issues such as Valencia, Toledo or (...) Zaragoza taifas. This study makes possible to point the historical moment when these coins were hoard. Most of them are from Sicily where they were minted in a moment when the Fatimids had no longer direct control of the island, and where the rubāʽas or quarter dinar predominated. In the Andalusian hoards, most of these coins were fractions of quarter dinar, in spite of the unit dinar that was the gold currency most used in Fatimid Empire. These fractional dinars should have been very valued during the 11th century in al-Andalus because of the quality of his alloy. The rubā‘as coexisted with the fractions of dinar strucked by the taifa kings and were treasured next to them. (shrink)

Research has shown that experiences of discrimination cause harm to the health and well-being of people. In terms of the identity of members of a group, a positive evaluation of that group might involve devaluing the out-group as a way of raising the endo-group, causing discrimination toward the out-group. In the Chilean context, the Mapuche people have historically suffered discrimination and violations of their rights. The aim of this study was to assess the relationship between Collective Identity, perceived experiences of (...) discrimination, psychological well-being and distress in the inhabitants of the Mapuche conflict zone according to their sense of belonging to their ethnic group. This descriptive, correlative, and cross-sectional study involved 200 participants, including 94 men, and 106 women, between the ages of 18 and 83 years old, who had lived for at least 1 year in communities in the Araucanía Region. The sample was stratified according their sense of ethnic identity, including 30% Mapuche, 33.5% Caucasian, and 36.5% Mestizo. The results show that participants with a sense of Mapuche ethnicity experienced more instances of discrimination, had a greater sense of collective identity, and that they also supported the Mapuche social movement and its methods. Based on evidence that well-being is directly related to collective identity, the study undertook a regression analysis of emotional distress and the psychological well-being of participants. The interaction between experiences of discrimination and collective identity has a significant influence. Collective identity and experiences of discrimination in themselves as well as the interaction between them, predict psychological well-being. The results suggest that the importance of the Mapuche group’s identity phenomena are related to a broad socio-historical context that leads them to identify themselves as a collective in conditions of inequality. This relationship between well-being and collective identity could be explained by their sense of cultural belonging, which can be a factor in protecting mental health. (shrink)

Describimos en este artículo algunos de los puntos que consideramos más relevantes y, sobre todo, menos trabajados, de lo que podríamos denominar "la herencia humana e intelectual de Bertrand Rusell". Concretamente, nos centramos en el estudio de dos materias a las que el filósofo británico concedió gran importancia: el amor y la pasión. Previamente, apuntamos aquellos acontecimientos y sucesos de su vida que hoy, tras los veinticinco años de su desaparición, nos pueden resultar de mayor interés.

En esta presentación realizamos un breve balance de la importancia del estudio de la racionalidad en la filosofía antigua, y presentamos un sumario de cada uno de los artículos que integran el volumen, los cuales dan cuenta de un amplio abanico de cuestiones que se abren a partir de su temática central: desde aspectos lógico-semánticos que atañen a las bases de la racionalidad en Aristóteles, hasta aquellas concepciones ontológicas en que la racionalidad tiene un papel preponderante, como la parmenídea y (...) la estoica, pasando por versiones más “blandas” de la racionalidad, en sede retórica y de filosofía natural aristotélicas. El biodeterioro de un soporte histórico es un fenómeno complejo que implica alteraciones de las propiedades físico-químicas y mecánicas del material por acción de organismos biológicos. A ello hay que añadir las modificaciones del aspecto estético que se producen en los objetos afectados. La intensidad de las alteraciones se produce en función de los componentes de los soportes y de las condiciones ambientales. Gran parte de las colecciones que se exhiben en los museos son de naturaleza orgánica, caracterizándose por su (...) alta higroscopicidad. Ello implica un significativo incremento del contenido de humedad del soporte, especialmente, cuando los objetos son expuestos a una insuficiente ventilación y a una humedad relativa superior al 65%. Bajo estas condiciones, numerosos materiales quedan expuestos al desarrollo de especies de microorganismos. A esta problemática, se une frecuentemente la presencia de insectos que pueden contribuir a la pérdida irreparable de piezas históricas en un breve periodo de tiempo. (shrink)

Carolina Sartorio argues that only the actual causes of our behaviour matter to our freedom. The key, she claims, lies in a correct understanding of the role played by causation in a view of that kind. Causation has some important features that make it a responsibility-grounding relation, and this contributes to the success of the view. Also, when agents act freely, the actual causes are richer than they appear to be at first sight; in particular, they reflect the agents' (...) sensitivity to reasons, where this includes both the existence of actual reasons and the absence of other reasons. So acting freely requires more causes and quite complex causes, as opposed to fewer causes and simpler causes, and is compatible with those causes being deterministic. The book connects two different debates, the one on causation and the one on the problem of free will, in new and illuminating ways. (shrink)

Negotiation and deliberation are two context types or genres of discourse widely studied in the argumentation literature. Within the pragma-dialectical framework, they have been characterised in terms of the conventions constraining the use of argumentative discourse in each of them. Thanks to these descriptions, it has become possible to analyse the arguers’ strategic manoeuvres and carry out more systematic, context-sensitive evaluations of argumentative discussions. However, one issue that still must be addressed in the pragma-dialectical theory—and other contextual approaches to argumentation—is (...) how to distinguish negotiation and deliberation in practice. In this paper, I seek to develop criteria that can help the analyst identify them in discourse. To this end, I characterise the felicity conditions of the superordinate speech acts defining and structuring deliberation and negotiation encounters. (shrink)

“Myth theorists” have recently called the normative requirement of means-end rationality into question. I show that we can accept certain lessons from the Myth Theorists and also salvage our intuition that there is a normative requirement of means-end rationality. I argue that any appeal to a requirement to make our attitudes coherent as such is superfluous and unnecessary in order to vindicate the requirement of means-end rationality and also avoid the problematic conclusion that persons ought to take the means to (...) whatever ends they happen to intend. Those who argue that corporations can be morally responsible for what they do help us to understand how autonomous corporate agency is possible, and those who argue that they cannot be help us maintain distinctive value in human life. Each offers something valuable, but without securing the other's important contribution. I offer an account that secures both. I explain how corporations can be autonomous agents that we can continue to be justified in blaming as responsible agents, but without it also (...) being the case that corporations are morally responsible for anything that they do. The upshot is that we can make sense of the reality of corporate agency and the value that we derive from our sophisticated interactions with them as autonomous agents, while vindicating the idea that they are not members of the moral community. Filón de Alejandría utilizó en diversos pasajes de su obra esta metáfora de procedencia órfica. Nuestro interés consiste en analizar el sentido que Filón le asigna y el modo en que reelabora el significado que le fue asignado en la tradición órfica y en la interpretación platónica. Intentaremos (...) mostrar que Filón utiliza la metáfora de dos maneras distintas que manifiestan la fuerte ambivalencia existente en su pensamiento respecto de la valoración del cuerpo humano. The idea that the body (σῶμα) is a tomb (σῆμα) where the soul remains confined as a punishment for an ancient fault is transmitted by Plato, who attributes it to the orphics. Philo of Alexandria made use of this metaphor of orphic origin in various passages of his work. Our interest is to analyze the sense that Philo assigns to it and the way in which he reelaborates the meaning that was ascribed to it in orphic tradition and in the platonic interpretation. We will try to demonstrate that Philo uses the metaphor in two different ways that show the strong ambivalence existing in his thought with respect to the value of the human body. (shrink)

El artículo analiza la hermenéutica del mito y la experiencia religiosa desarrollada por Pareyson y su crítica al nihilismo “sofisticado”, tal como es ilustrado por Dostoievski en su personaje Iván Karamázov. Frente a la aceptación fáctica del mundo tal como es por parte de Iván, quien rechaza la “violencia de Dios”, Pareyson contrapone una reflexión sobre el cristianismo caracterizada por lo que denomina “pensamiento trágico”: este establece que el sufrimiento constituye el principio y el fundamento de la solidaridad entre Dios (...) y el ser humano.
